Welcome to Chitrabzaar! These Terms and Conditions (“Terms”) govern your use of Chitrabzaar’s website, mobile applications, and services (“Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

  1. Services and Fees:

Chitrabzaar provides a platform for customers to connect with photographers and videographers (“Creatives”) for various IT, Web Development, photography and videography services (“Services”). Fees for Services will be determined by the Creative and displayed on the Platform. You understand and agree that Chitrabzaar does not set or control the fees for Services and is not responsible for any disputes arising from such fees.

  1. Payment Policy:
  • All payments for Services must be made through Chitrabzaar’s secure payment gateway. You agree to provide accurate and complete payment information, and authorize Chitrabzaar to charge your chosen payment method for the agreed-upon fees.
  • All payments are non-refundable. Once a booking is confirmed and payment processed, you will not be entitled to a refund under any circumstances, except in cases where the booked Creative cancels the booking due to their own reasons.

  1. Booking Process:
  • To book a Service, you must create an account on the Platform and provide accurate and complete information.
  • Once you find a Creative and Service that meets your needs, you can send a booking request. The Creative has the right to accept or reject your booking request.
  • If your booking request is accepted, you will be required to confirm the booking and make the payment through the Platform’s secure payment gateway.
  • Upon confirmation and payment, you will receive a booking confirmation email and all communication with the Creative will be facilitated through the Platform.
  1. User Content:
  • You are responsible for any content you upload, share, or create on the Platform (“User Content”). You represent and warrant that you have the right to submit such User Content and that it does not infringe on the rights of any third party.
  • You agree that your User Content will not be offensive, discriminatory, illegal, or harmful in any way. Chitrabzaar reserves the right to remove any User Content that it deems to be in violation of these Terms or inappropriate.
  1. Disclaimers and Warranties:
  • The Platform is provided “as is” and without any warranties of any kind, express or implied. Chitrabzaar disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Chitrabzaar does not warrant that the Platform will be uninterrupted or error-free, or that any defects will be corrected.
  • Chitrabzaar is not responsible for any damages or losses arising out of your use of the Platform, including, but not limited to, direct, indirect, incidental, consequential, and punitive damages.
  1. Limitation of Liability:
  • In no event shall Chitrabzaar be liable for any damages or losses arising out of your use of the Platform, even if Chitrabzaar has been advised of the possibility of such damages.
  • Your sole remedy for any dissatisfaction with the Platform is to discontinue using it.
  1. Term and Termination:
  • These Terms will remain in effect until terminated by you or Chitrabzaar.

  • Chitrabzaar may terminate your account/service at any time, for any reason, without notice.
  1. Governing Law and Jurisdiction:
  • These Terms shall be governed by and construed in accordance with the laws of Nepal.
  • Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Bagmati Province, Nepal.
  1. Entire Agreement:
  • These Terms constitute the entire agreement between you and Chitrabzaar with respect to your use of the Platform.
  • These Terms supersede all prior or contemporaneous communications and agreements, whether oral or written.
  1. Amendment:
  • Chitrabzaar may amend these Terms at any time by posting the amended Terms on the Platform. You are responsible for reviewing the Terms regularly for updates. Your continued use of the Platform after the posting of amended Terms constitutes your acceptance of such amendments.
